The Carrier undertakes to carry passengers and vehicles following the following General Conditions of Carriage (hereinafter, “General Conditions”), which are adequately advertised at all ticket offices, social offices, travel agencies and the Command on board, as well as on the Carrier’s website (hDps://blunavytragheG.com; hereinafter, “Site”).
The term “Passenger” means any person carried under these General Terms and Conditions. In addi9on to these General Conditions, the Passenger is also required to comply with the requirements dictated by Italian, Community and international rules and regulations as well as the regulations of the Carrier and the provisions of theShip’s Commander. The term “Carrier” and/or “Company” means BN di Navigazione S.p.A., with registered office in Portoferraio (57037) at via Calata Italia, no. 24A, Tax Code and VAT no. 01968710994.
The object of the contract is the provision of transport as governed by Articles. 396 et seq. Code Nav.. Where the name of the ship that will perform the carriage is present on the ticket, the same must be considered merely indica9ve, being in the faculty of the Carrier to perform the transport with another ship. The Carrier declines all responsibility for damage caused to the Passenger by delay, interruption or non-performance of the carriage, as well as by the modifica9on of the itinerary or, if the event derives from unforeseeable circumstances, force majeure, adverse weather and sea conditions, strikes and technical failures or other causes not attributable to it. In any case, the Master of the ship has the right to cancel or interrupt the race or to modify the itinerary in the event of events that may compromise the safety of the ship and/or passengers. The fares and these General Conditions are subject to change un9l the 9me of ticket issuance. Throughout the journey and un9l the 9me of disembarkation, Passengers are required to keep their luggage and other personal effects (if carried outside of baggage), and ensure that these do not constitute danger or hindrance to other Passengers and / or crew, and remain fully responsible for the same and for everything contained in the baggage. Crossing times are calculated on the basis of the distance between ports and in favorable weather and sea conditions. The Carrier cannot beheld responsible for delays due to port opera9ons. All persons on board are subject to the authority of the Master of the ship, who is given the disciplinary power provided for by law (Article 186 of the Nav. Code). The Passenger, from the beginning of the embarkation opera9ons un9l the end of the disembarkation opera9ons, must comply with the prescriptions, regulations and provisions in force on board and/or dictated by the Master or any member of the ship’s crew and/or otherwise diffuse by the Carrier or its personnel. The Passenger must also base his behavior on common diligence and prudence, monitoring the safety and security of his person, people and animals that are in his custody, and this even more during adverse weather conditions; the Carrier is therefore not liable for any damage deriving from the Passenger’s failure to comply with these rules of conduct. The Carrier is also not liable for expenses and damages to persons, luggage and things accompanying the Passenger deriving from force majeure, unforeseeable circumstances, sea luck and any other event not attributable to it. In case of liability of the Carrier, the limitations of the Law will apply.
The ticket is personal, is non-transferable and is valid only for the transport specified in it. When issuing the ticket, the Passenger is required to provide the following personal data: Surname, First Name, Gender, Nationality, Age Category (infant, child, adult), special care and assistance that may be necessary in the event of an emergency (if requested by the Passenger), and at least one contact between ind. irizzo email and mobile phone for sending the ticket and any communications for the management of the race or any emergencies by the Carrier.
Upon delivery of the ticket, the Passenger is required to verify the accuracy of all the data contained therein(date, es9mated 9me of departure, number and type of passengers, characteristics and license plate of the vehicle, any supplements).
The Carrier will not assume any responsibility for errors or omissions reported subsequently; Tickets bearingcancella9ons and/or corrections shall be considered null and void.
If the ticket was purchased on the Website, in the event of non-receipt of the ticket at the contact (email and/or mobile phone) communicated by the Passenger at the 9me of purchase, the Passenger mustreport such non-receipt by email to the Carrier at the address: [email protected] ; the issue of the duplicate can only take place on condition that the original ticket is not already used, subject to identification of thePass eggero. The Carrier assumes no responsibility in the event that the Passenger makes mistakes in the indica9on of his contact (e- mail and/or mobile phone) at the 9me of purchase of the ticket.
The Passenger is obliged to keep the ticket to justify his/herright to carriage and to present it to any member of the ship’s crew or personnel of the Carrier who so requests. If it is found that the age of the Passenger does not correspond to what is indicated in the ticket, the Passenger must regularize his/her ticket at the BN ticket offices located in the ports of Piombino and Portoferraio by paying the fare difference provided that there is sufficient 9me for such regularization before the departure of the ship, which cannot be delayed. If non-conformi9es are found between the type of vehicle and the tariff category of competence, we will proceed with the cancella9on of the ticket and simultaneous issuance of a new ticket at the BN ticket offices located in the ports of Piombino and Portoferraio only if at that 9me there is availability of space and provided that there is sufficient 9me for such cancella9on and issuance before the departure of the ship, whereas it cannot be delayed; In case of unavailability of seat, the vehicle will not be allowed to board. For the purpose of determining the applicable reduced tariff, “child” means those who have already completed the fourth year of age and not yet the twelfth (4-11), and “infant” means those who have not yet reached the fourth year of age (0-3).
Only tickets issued at the standard fare may be refunded, provided that the cancella9on is requested by the Passenger no later than 24 (twenty-four) hours before the departure time to which the ticket refers. The refund must be requested:
(a) at the ticket offices managed by the Carrier, for tickets purchased at one of these ticket offices or at the Site. In this case, a special form will be delivered to the Passenger requesting reimbursement, which the Passenger will be required to submit and send, within the aforementioned period, by e-mail to: [email protected]; the subsequent reimbursement will be made by the Carrier by bank transfer;
(b) at the retailer where the ticket was purchased, where such purchase was made through travel agencies, Tour Operators, ticket offices not managed by the Carrier and/or other types of retailers (including websites other than that of the Carrier). In this case, the refund will be made to the Passenger directly by the retailer, always on condition that the laDer receives the cancella9on request within the aforementioned period of 24 (twenty-four) hours before the departure to which the ticket refers;
(c) at the ticket offices managed by the Carrieror by contacting the Carrier’s call centre, regardless of the way in which the ticket was purchased, the Passenger may request – always within the aforementioned period of 24 (twenty-four) hours before departure to which the ticket refers – the cancella9on of the 9cket and receive, as an alterna9ve to a cash refund, a coupon for an amount equal to that of the refund, which the Passenger must use within 12 months from the date of issue. The coupon cannot be combined with other discounts, coupons, benefits or promotional initiatives of the Carrier;
(d) for tickets purchased at the Site only, the Passenger may request, by accessing the Site and always within the aforementioned period, the cancella9on of the ticketand reimbursement by purse, governed below in this article 3.
The refund of the ticket at the standard fare is subject to the following penal9es: 10% reduction for tickets cancelled within 30 days prior to the departure date; 20% reduction for tickets cancelled within 10 days prior to the departure date; 30% reduction for tickets cancelled within 48 hours prior to departure 9me; 50% reduction for tickets cancelled within 24 hours and before the departure time. For the calculation of the above penalties, the amount of the tickets must be understood net of booking fees, as well as taxes, supplements and other rights referred to in art. 15 of these General Conditions. Starting from 24 (twenty-four) hours before the ship’s departure 9me, it will be possible to request the cancellation of the ticket, it being understood that the Passenger will not be entitled to any refund nor can he claim any other right and / or claim for such cancellation. In any case, no refund will be granted if: (i) the ticket has been issued at a non- refundable fare; (ii) the Passenger does not show up for departure within the 9me limit established for boarding provided for by art. 9 of these General Conditions; (iii) the ticket has not been cancelled in the manner described above within 24 hours before the departure 9me; (iv) the ticket was issued at a fare for residents, natives, homeowners on the Island of Elba and commuters. Reimbursement by purse: for tickets purchased on the Site only, the Passenger may request the cancella9on of the ticket and receive the amount of the refund provided for in this article 3 bycrediting his “purse”. To take advantage of this refund method, the Passenger must have already activated – before the request for cancellation of the ticket – the purse mode on the Website. The amount thus credited in the purse can and should be used to purchase one or more new tickets of the Carrier, up to the amount credited, it being understood that these new tickets must always be made out to the Passenger holder of the purse.
The loss or the; of a ticket must be immediately reported to the issuing agency or to the ticket offices of Piombino and / or Portoferraio within the 9me limit established for boarding provided for by art. 9 of these General Conditions. The duplicate can only be used on condition that the original ticket has not already been used, upon presenta9on of an identity document.
Date and time changes on ordinary tickets only will be accepted provided that they are requested before the time limit for boarding, as required by art. 9 of these General Conditions, subject to availability on board and payment of any difference for price adjustment. Price differences in favour of the Passenger will not be refunded. The varia9on is allowed only in the context of departures published on the Site. Variations on tickets that are requested on the same day of ticket purchase do not involve the application of penalties. The change in the number and type of passengers and / or vehicles involves the cancella9on of the ticket, with the applica9on of the penal9es provided for by art. 3 of these General Conditions and the reissue of a new ticket.
The Company recognizes the applica9on of preferential rates for residents in one of the Municipalities of the Island of Elba or the Municipality of Piombino, for natives in one of the Municipalities of the Island of Elba, for owners of a house located in one of the Municipali9es of the Island of Elba and for commuters (the laDer only with a bridge pass pass ). The facilita9on also concerns vehicles, if registered to resident passengers or companies with registered office in one of the municipali9es of the Island of Elba or the Municipality of Piombino, or to na9ve passengers or owners of a house located in one of the municipali9es of the Island of Elba. To obtain the facilita9on, the Passenger must show, at the time of purchase of the ticket and boarding, a valid identity document, certifying residence or birth in one of the Municipali9es indicated above, as well as the registra9on number of the vehicle in tow, and will be required to show them at any request of the on-board staff and / or persons in charge of the Company.
With the exception of commuters, the Passenger may vary, one or more times, the date and 9me of departure of the ticket purchased with the facili9es provided for in this article, provided that such varia9on is requested at the ticket offices of the Carrier located in the port of Piombino and Portoferraio and that there are places available on the new date and 9me requested, and in any case in compliance with the following terms:
(i) for residents in one of the municipali9es of the Island of Elba or the Municipality of Piombino, the 9cket must be used by 31 December of the year of departure for which the 9cket was originally issued;
(ii) for natives in one of the municipalities of the Island of Elba, and for owners of a house located in one of the municipali9es of the Island of Elba, the ticket must be used within 30 days following the departure for which the ticket was originally issued;
after these deadlines, the ticket will be cancelled and the Passenger will not be entitled to any refund, either in whole or in part, of the relative amount and will not be able to claim any other right and / or claim.
To obtain the applica9on of the discounted rate for the owners of a house located in one of the Municipalities of the Island of Elba, it is mandatory to register in the appropriate register kept by the Carrier, presenting to the laDer all the documenta9on necessary to certify the ownership of a housing unit in one of the Municipalities of the Island of Elba; the facilita9on will be reserved for a single owner of the property and a single vehicle. Every two years it will be mandatory to submit the renewal of the documenta9on necessary to maintain the conditions for benefiting from the benefits, in this period of time the applicant undertakes to promptly inform the Company in writing of any change in these conditions.
For owners of a house located in one of the municipali9es of the Island of Elba, the tariff concession will be within a maximum of 30% discount compared to the ordinary rate applied to the relative race.
For residents in one of the Municipali9es of the Island of Elba or the Municipality of Piombino, and for natives in one of the Municipali9es of the Island of Elba, the relative rates will instead be published by the Carrier from time to time.
If at boarding the Passenger does not have the documents certifying the right to the reduced fare referred to in this article, the ticket will be canceled, no refund will be recognized and the Passenger will be required to pay the entire ticket at the cost of the ordinary fare applied to the journey booked, provided that there is sufficient 9me for such regularization of the ticket before the departure of the ship, which cannot be delayed. If it is found, during boarding or on board, the transfer to third par9es (and family members) of their travel document issued at a discounted rate for owners of a house located in one of the municipali9es of the Island of Elba, the company reserves the right to definitively revoke the facilita9on granted and to delete the offender’s no. from the aforementioned register.
For commuters (bridge crossing pass) it will be necessary to present the following documentation: 1 passport photo, certificate of residence in one of the municipalities of the Island of Elba and copy of the employment contract with an employer located on the mainland.
Any tickets issued with other promotional offers are never refundable. Special offers are available subject to availability and cannot be combined with other discounts/promotions.
The Carrier is available to recognize discounted rates for groups of at least 10 people. More information (including regarding the applicability of cancellation and change policies) maybe requested from the Carrier via the e-mail address [email protected] or travel agencies.
The time limit to show up at check-in is 15 minutes before the scheduled departure time for passengers without a vehicle, and 30 minutes before for passengers with vehicles, except for any instructions given by the Authorities. Check-in takes place at the ship’s ramp. After the aforementioned deadlines, the Carrier does not guarantee the packaging. This is without prejudice to the provisions for Passengers with disabili9es or reduced mobility.
Passengers travelling with accompanying vehicles must comply with the following requirements: A) LPG-powered vehicles must be declared to the crew at the time of boarding and must present themselves for boarding with the tank half empty; B) the electric alarm and anti-the; systems must be switched off at the time of boarding. For the purpose of identifying the tariff category to which they belong, the lengths of the vehicles are always understood as “overall”, and therefore include tow hooks, rudders or other protrusions. Cars with an overall length of more than 6.00 meters must be booked in one of the “Camper/Minivan” categories depending on their length. Cars characterized by an extra height (thule, suitcases, sports equipment and so on) are subject to the payment of a supplement. For the purposes of correctly identifying the tariff to which it belongs, the definition of the vehicle shown on the registra9on document is authentic. The vehicles will not be embarked in the chronological order of their arrival at the quay, but according to the instructions given by the Master of the ship and / orhis subordinates and may be placed on any deck of the ship. They must be parked with the handbrake pulled and the gear engaged, and will be boarded and disembarked at the sole care and responsibility of the Passenger. The vehicle, including any trailer or caravan with what is contained therein, is accepted by the Carrier as the only unit of load without declaration of value. Also pursuant to art. 412 and 435 Code Nav. any damage to the vehicles or any harmful eventoccurring on board the Carrier’s ships must be declared prior to disembarkation. To this end, the Passenger must submit a complaint to the Captain and/or to one of the officers on board who will collect the complaint with a special form, which must be signed by the Passenger, without prejudice to any rights and/or exceptions of the Carrier.
In the event that the Passenger, who has not previously purchased the ticket, presents himself at the check-in point or asks to be able to purchase the ticket, theCarrier reserves the right to accept this request – upon payment of a surcharge – by issuing the relevant ticket also on board the ship, provided that: (i) the request to purchase the ticket occurs within 15 minutes prior to the scheduled departure time, or 30 minutes for Passengers with vehicles; (ii) at the time of the request to purchase the ticket there is availability of seats on board; and (iii) there is sufficient time for the ticket to be issued before the departure of the ship, which shall not be delayed. The purchase before the aforementioned times can only be made at the ticket offices of the Carrier located in the ports of Piombino and Portoferraio.
The Company’s ships do not have cages and/or other means of transport for animals and, due to their technical characteristics, are intended only for the transport of passengers and vehicles. Pets are therefore only allowed on board on the outer decks of the ship. It is allowed, upon purchase of the relevant ticket, the transport of a pet accompanying the Passenger, under the following conditions: a) from the moment of embarkation and until disembarkation, the dogs must be muzzled and leashed or, alternatively, must remain inside the appropriate carrier, which the Passenger will take care to embark; the cats must be kept in the same carrier, as well as birds in special cages embarked by the Passenger. The embarkation of carriers and cages does not generate a surcharge on the tariff applied for the passage of animals; b) the animals must be transported in such conditions that they cannot cause damage or inconvenience to other Passengers and / or the ship. The payment of the ticket is not due for guide dogs intended for the assistance of blind people, with relative documentation, who will be able to access the internal areas; as far as reason, the provisions of EU Regulation no. 1177/2010 apply to assistance dogs for people with disabilities or reduced mobility. The Carrier reserves the right to request, before boarding and at any time during the trip, health certification certifying the state of good health and the vaccination record of the animal. Certifications showing release dates prior to 90 days from the date of departure will not be considered valid. Maintenance, custody and care of animals during transport are at the expense and risk of the Passenger, who is required to comply with the health provisions dictated on the subject by the Competent Authorities and any other provision issued by the Captain. The Passenger undertakes to indemnify and hold harmless the Carrier from any and allliability, burden, cost and/or expense that the Carrier may suffer, also as a result of claims by third par9es, which are connected or consequent to the actions of their animal (including assistance dogs for people with disabili9es or with disabilities or with reduced scope of the provisions of EU Regulation no. 1177/2010) or that are the result of the Passenger’s non-compliance with the regulations and provisions referred to above, as well as existing laws on the subject.
The Data Controller is BN di Navigazione S.p.a in the person of its legal representative pro tempore. The interested party has the right to exercise the rights provided for by EU Regulation 2016/679, Legislative Decree 192/2003, Legislative Decree 101/2018 and subsequent amendments.

For anydispute arising from the interpretation and/or execution of these General Conditions, the competent court is exclusively that of the registered office of the Carrier, unless the Passenger holds the status of consumer, in which case, where required by applicable law, the court of residence or elective domicile of the same will be exclusively competent.
Port taxes, fuel surcharge, disembarkation fee and all other fees and surcharges are always excluded and to be added to the rates applicable to the journey. The relative amounts are subject to change up to the time of ticketissuance, without prejudice in any case to the Carrier’s right to make changes at any time as a result of changes in the regulations in force.
Passengers are required to present their travel ticket and identity document if requested by ship personnel. Passengers, at the time of boarding, are also required to take from the vehicles all valuables and what they need during the crossing. It is absolutely forbidden to get off the ship after having carried out the boarding operations. If the ship has a side entrance for foot passengers, access to the garage with the vehicle is allowed only to the driver, while accompanying passengers must use the side staircase with the boarding pass issued at check-in. It is absolutely forbidden to enter the ship’s garage during navigation. During the stop of ships in port it is forbidden to approach less than 50 meters from the aveand moorings.
In uncomplicated conditions of pregnancy at the end of the 6th month of pregnancy, it is necessary to obtain a medical certificate, issued no later than 48 hours before departure, authorizing the trip, to bepresented to the ship’s personnel who request it. In the presence of complications, the pregnant passenger must instead be provided with a medical certificate authorizing travel regardless of the months of pregnancy.
Passengers aged between 14 and 18 may also travel unaccompanied, under the responsibility of the holders of parental authority, provided that they deliver at the 9me of boarding a leDer signed by both parents according to the model available on the Carrier’s website, with the family status and the documents of both parents, aDached, with which they declare to assume all responsibility for any damage suffered by the minor and / or caused to third par9es or to theship. Under no circumstances shall the Master of the ship and/or other crew member assume custody, and consequent responsibility, of the minor. Children under the age of 14 may travel alone, but also by delivering to the Carrier at the 9me of boarding the accompanying declaration required by law signed by their parents. All minors must have a valid identity document.
Without prejudice to the provisions for Passengers with disabili9es and Passengers with reduced mobility pursuant to EU Regulation no. 1177/2010, the Carrier does not accept Passengers who need medical assistance during transport unless accompanied by authorized medical or paramedical personnel. Without prejudice to the faculties provided for by art. 192, co. II, Cod. Nav. the boarding of passengers manifestly suffering from serious illnesses or in any case dangerous for the safety of navigation or for the safety of persons on board is subject to authorization by the competent Authorities. In the presence of a suitable medical certificate stating that the Passenger does not require medical assistance during transport, the Carrier will have the right to embark this Passenger declining any responsibility in this regard. It is also submiDed to the judgment of the Captain and the ship’s doctor, where present, the boarding of the Passenger who is in physical or mental conditions such that do not allow him to deal with the journey or such as to cause harassment or cause danger to himself and others, by way of example and not exhaustive for drug abuse, hallucinogens and alcohol. In all the aforementioned cases, the Passenger will only be entitled to reimbursement of the bigpayment paid, and nothing else can claim for any reason; he will also be responsible for damages caused to his person, to the ship, to all its equipment or equipment, to third par9es as well as to third party things. The acceptance of the Passenger on board by the Carrier shall not be considered as a waiver of any right by the Carrier to subsequently assert its reservations about the Passenger’s condition, whether or not known by the Carrier at the time of embarkation and/or departure of the ship.
Assistance to passengers with disabilities and passengers with reduced mobility is provided within the limits of the provisions of EU Regulation no. 1177/2010. The request for assistance must be sent to the Carrier at least forty-eight hours before assistance is required. The Carrier will send the Passenger written confirma9on, by SMS or e-mail to the references provided by the Passenger, of receipt of the request for assistance; it is the Passenger’s responsibility to ensure that he has received such confirmation of receipt and to present it at check-in. At the same time as purchasing the ticket, the Passenger must also inform the Carrier of his/her specific needs regarding accommodation, seat, services requested or the need to carry medical equipment. In order to ensure the implementa9on of the provisions of the aforementioned EU Regulation no. 1177/2010, the Passenger must appear in person, at the place designated and made known by the Carrier after the latter has received the request for assistance, at least 60 minutes before boarding 9me. If the Carrier requests accompaniment by another person who can assist the Passenger, such companion will travel free of charge.
The offices and our port ticket offices are available for any informa9on, quota9ons and reservations relating to the transport of goods.
Pursuant to art. 384 Reg. Nav. Mar., Passengers at the time of embarkation must deliver to the Master of the ship, who will keep them until the time of disembarkation, the weapons and ammunition in their possession. The withdrawal of weapons or ammunition from those who possess them because of their office or service is allowed only for serious and ascertained reasons to be indicated by a specific declaration at the time of withdrawal. Failure to report the transport of weapons is sanctioned on the basis of art. 1199, co. II, Nav. Code, unless it constitutes a more serious crime. Anyone intending to embark dangerous goods of any kind and species is required to give written notice to the Carrier at the 9me of purchase of the ticket, in order to verify whether the relevant ship is authorized to transport dangerous goods and providing all the useful information, and in any case all those required by the carrier, for the purpose of classifying the goods. The Master of the vessel reserves the right, in any case, not to take on board goods which in his judgment are considered dangerous.
If the Passenger forgets or loses personal belongings on board, he/she may contact the cabin crew or the ticket offices or report the loss by written notice to the Carrier’s e-mail address: [email protected]. The Carrier is not obliged to pay any compensation in the event of failure to find the items forgotten or lost on board by the Passenger.
For anything not covered by these General Conditions, Italian law and EU Regulation no. 1177/2010 apply.
If a Passenger wishes to submit a complaint to the Carrier pursuant to EU Regulation no. 1177/2010, they shall submit it within two months from the date on which the service was provided or should have been provided, by e-mail to the address [email protected] using the form downloadable from the Site. The form can be completed inItalian and English. Within one month of receipt of the complaint, the Carrier shall notify the Passenger that the complaint has been accepted, rejected or is still under consideration. The time required to respond definitively shall not exceed two months from receipt of acomplaint. In the event of failure to respond to the complaint within the above terms, the Passenger may, in addi9on to any other legal remedy, submit a second instance complaint to the Transport Regulation Authority, in the manner indicated on the website of that Authority (https://www.autorita-traspor9.it/).
Without prejudice to anything else provided for by the applicable legislation, any economic compensation due by the Passenger to the Passenger in cases of delay in arrival is calculated in relation to the price paid of the ticket and is guaranteed according to the minimum level referred to in art. 19 of EU Regulation no. 1177/2010. In any case and without prejudice to any other exemption from the law, where applicable, in the event that the delay is known to the Passenger before the purchase of the ticket, is caused by the Passenger, is caused by weather conditions that jeopardize the safe operation of the ship or by extraordinary circumstances that hinder the execution of the service, not avoidable even by taking all reasonable measures, Compensation is not due. Requests for compensation of less than 6 euros will not be accepted, both in the case of individual tickets and in the case of season tickets.
